You may have missed this post of mine earlier. . .

Just to add something useful to this (my banking credentials previously mentioned). That "endorsement" is actually called an instruction on the back of the check and has absolutely NO legal weight. There are only a few legally recognized instructions (such as "for deposit only") and that is not one of them. For such an instruction to be legally binding you would have to both agree in writing on a seporate contract. AND for a contract to be binding you would have to be offered some sort of compensation in consideration for following that instruction. Your refund, that you are already entitled to, is not that compensation.
|
Now if it is of concern to you draw a single line through all of their instructions and write something to the affect of "I do not agree to these conditions but do accept my refund in full." and sign it.

L1A1Rocker,
I did see your post on the subject, but wanted to talk to the AG to verify, no offense. He did not state it as absolutely as you and would not tell me that it was OK to ignore, but called it "unenforceable." Regardless, I deposited the check today. The AG was surprised that the checks were going out that way though.
I was the first to contact the trooper or the AG and let them know that a refund had been issued. If you filed a complaint and have gotten a refund you should let them know. I did make it clear that the check had not cleared yet if that is what some are waiting for. The AG is going to keep my name on the complaint until it is resolved completely, but for all intents and purposes this appears to be over for me.

yes please...
If you get a refund check Please let us know when you ordered, and how much you got.
Just to see if there is a method of order date or small amounts first

My order was for 2. Total was $182.
I was part of the CC fiasco, and I sent a money order Dec. 12, 2008.

Only makes sense. If you want to eliminate the most complaints then refund the lowest dollar orders (which are the majority). Think about it - for a $1000 you can eliminate 1 or 2 big orders or 10-12 small orders - what would you do if your trying to convince the AG your making good on the debts to keep your ass (or your son's) out of jail.

i am officialy done with this fiasco.
my refund check cleared. ($281).
i ordered 2 receivers in september or october, whenever the GB first started. then sent in a check for one more receiver in january.
so long penleys, it has been a terrible experience, one which i never wish to repeat.
I wish all you gentelmen & women the best of luck to get your refund in a timley maner.

I left about $100 on the table ( shipping and insurance) and had the expense of going up there in person. It sux but is better than loosing $3700
