I just spent a long while reading the entire suit. I don't see how a competent court can review all of the exhibits attached, and side with ATF on this. It is very clear, to the point, presents a multitude of examples where ATF has ruled other devices operating on the same principle are legal, and furthermore, it challenges how ATF defines a machine gun quite well.
I think its important to note that it will not be ATF making any ruling or decision on this now, it will be a federal judge and court deciding if ATF overstepped it's authority. I think at the least, if the court finds the ATF overstepped, that at least all Akins Accelerators which are already on the market would have to be allowed as they were made, marketed and sold under the umbrella of ATF declaring them legal and not MG's.well i can see one of two things happening. 1) they rule the AA is not a machine gun or 2) they uphold the MG ruling and start looking more closely at the tac and other trigger devices that are described.
