In addition to the case I have filed in the Federal court of claims in Wash D.C., my attorney has now filed another case in Florida federal district court. Same issue. BATFE arbitrarily declaring the Akins Accelerator rifle stock to be a machine gun. My attorney has now filed two pending federal court cases filed at the same time against the BATFE regarding this issue.

This is to inform the public and former customers that as a private individual and successor in interest to Akins Group Inc., I am still fighting for their rights to own a fully functioning Akins Accelerator.

I cannot elaborate on the particulars of either of the cases on advice of my attorney.

Here is the link to the latest complaint in Florida federal district court.

Well, I don't know what happened to my previous post, but I WANTED to say "Way to Go Bill!" Now, maybe someone I know of will get their thousand dollar spring (Second Amendment, PRICELESS) back!

Carry On!

I thank everyone for their kind words of support. I appreciate it very much. My attorney John Monroe has set up a legal expense fund for this cause. Here is what he says from another forum....

" Legal Expense Fund
To those of you interested in contributing to a legal expense fund for this cause, donations may be made payable to "John Monroe Trust Account" and mailed to the address shown in the below Federal court of claims complaint. I'd rather not put the address directly in this post, so data miners don't find it and start in with junk mail. Please indicate on the check or cover letter that the donation is for this cause (William Akins v. United States).

Thank you in advance for you donations and support of this cause.

Attorney at law, John Monroe."

Counselor Monroe's address to send donations is on page 8 of the first of our two complaints located at this link..
http://www.georgiapacking.org/docs/akins/Complaint_with_exhibits.pdf

So counselor Monroe has set up a fund for our legal costs and I will guarantee anyone who contributes $1000.00 or more a free fixed stock or a folder stock for contributions of $1200.00 or more when we prevail.

I have a question about this case, if anyone knows the answer. In re-reading the suit, it states

"On or about Novermber 22nd, 2006.......The letter advised Bowers that Akins Group Inc. either had to register it's Akins Accelerators on hand as machine guns in accordnance with 26 U.S.C. or surrender them"

Does that mean that they offered to amnesty register the Akins Accelerator?

If so, it is interesting in that it would be a post aknowledgement by ATF that the AA was built and sold legally under their approval, hence they were forced to at the least accept those already in circulation as legal MG's?

It's a question of "Honor"...

Alamo,

An honorable agency WOULD allow an amnesty, encompassing everything from AA to pre-Vietnam bring-backs, as THEY are the ones who caused this whole damn fiasco in the first place. Somebody has to say it, somebody with some common sense, I just did. There are some agents within this agency who see they work for lunatics, I thank them for exposing a lot of the problems within that agency, and for helping good people deal with some clueless moron behind a desk. ;)

No, JBTs demand all the AAs be post-samples, which means AA allowed post-samples to go out with no paperwork, this could've been MUCH worse but they allowed some wiggle room, allowed AA to either get the units back or "find a way to NOT allow them to work", surrender and confiscation was discussed, the situation has been temp resolved by deleting and turning over the EVIL spring. Never mind the attempt to destroy/bankrupt AA, which has been what FTB/DOJ is trying to do.

Bill, when you are asked to fight for your country, then later forced to battle your country's overbearing govt, disturbs me to no end, I hope you hand FTB their ass in a sling! :D

The way it's written and I consequently interpret it, it seems to say that he had to either surrender, destroy or have them registered as MG's. If he had taken the registering as MG's path, would they have been transferable to individuals? They didn't seem to elaborate on what that meant.

Oh well, I have one of his AA units, so hopefully the court will see what a crock ATF pulled and order them to allow the AA or to allow individuals to register them.

The best possible ruling that could come of this is the court declaring that under the defiinition currently in place for an MG, that the device does not qualify as such.

If they order ATF to allow the units (if that's even possible for the federal court to order), there's a whole slew of possibilities here. If ATF classifies the spring and mechanism as the MG but not the stock, Akins or a third party would be open to manufacturing a stock to accept for example, a mini 14 which could then accept the newly registered spring and mechanism, thereby allowing caliber swaps with the device. Wouldnt that be sweet.

I'm rooting for Bill, he got the shaft and no morning after kiss...

It disturbs me too Blackrifles. During the Vietnam conflict, when I voluntarily enlisted in the Marine Corps, I took an oath to defend and protect the constitution against all enemies both foreign and domestic. It is indeed disturbing to realize over 30 years later, that my own government that I was willing to die for, has now become that domestic enemy that oath was talking about.

Wow this entire thing makes absolutely no sense at all. On the part of the Gov.it is like the left hand is ignorant of the right hand ,much less knowing what is doing. I mean this isn't a sear or a FA trigger pac , it is a contraption looking thing. In listening to ATF if i have a sight on a rifle that looks like one on a MG they could get huffy and do this same crap ,I'm only making an example but this is just about as stupid .Guys i don't get it ,the guide lines are getting all blurred , and other things are exaggerated to the point it is ridiculous .
Good luck Bill ,we need to pray for you ,this shouldn't even be in court.

Phalanx,

You could compare it to rabid animals, you make no sound/sudden movements, you might get bit. Make noise/move fast, you WILL get chased down and bit.

Somebody needs to remind Congress what should be done to rabid animals, wait one, there would not be so many running for those positions, would there? ;)

blackrifles it just makes no sense ,i have read this story from the day it started on this site and i still don't know why ATF is acting like this.
Bill submitted a sample ,he never hid anything from them . If they didn't like it why didn't they stop it then? But to come back later and throw a fit like this is beyond me. They are costing this man big bucks ,while they try to cover up their own screw ups. And you and me are paying for their case.

Phalanx,

Simply put, like most CORRUPT govt agencies, they're creating problems to justify a reason to exist.

I have ZERO doubt Bill is in the right, did everything in compliance, but some people within FTB changed the rules in an effort to ruin him.

Well there is something very wrong with this picture here ,I remember when Bill was taking orders on these ,he had a Letter on compliance and wasn't doing anything under the table. If anything the it only confirms the state of power mongering and incompetence of this agency.Do you think the entire deal with the Treasury trying to dump them made them try to show that they were on the job and a needed entity?
