My wife and I were ran over while riding my Harley in Sept.07. I am now learning to walk again with new leg, titanium knee , tibula ,fibula ,and ankle.
OK now on to the point in Local Ohio paper man was arrested for carrying a firearm concealed. The law enforcement officer said to the paper the man was physically handicapped and his CCW permit was not valid at that point.
As of 2008.

He should of turned his license in for being handicapped?

I am an 03 soon to be 01 license holder and a CCW holder and just applied for
a one year disability claim just till I learn to walk again.


Before I start calling local law enforcement, does anyone here have any information about this? I have not been made aware through state or gov. of any physical disqualifying handicaps, only mental disqualifying paper I got a few months back from the ATF. Thank You

Hi, i'm in Ohio aswell and have a ccw but am not aware of the hanicap thing, seems this would be a good time to have ccw if you ask me. You may want to post on ohioccw.org site there are a lot of people in the know on that site. Hope that helps.

where abouts in ohio are you? I'm in the lake county/geauga county area.

Wow... That just doesn't make sense. I would think that physically handicapped people would need the ability to defend themselves more than anyone. Let's face it. They would make an easier target than someone who is physically fit.

Sorry to hear about your leg. Is it a below the knee amp? Keep us posted on the progress. I have a partial paralyzed left leg myself that I received in 2002 in the military. All I have read about restrictions is on mental conditions. I know they were pushing to allow doctors to give an opinion on owning firearms with a mental condition regardless of the degree, but it didnt go threw. I believe right now you have to be deemed incompetent to loose any of your rights. If you are deemed incompetent due to physical handicaps, it may be the same as mental when it comes to firearms.

they might have some info on such a thing - keep us posted, I would be frightened to find that this is in fact true and I was medically retired from the military and rated at 80%.

That sounds like a great ADA lawsuit, in most places you have to be very careful about disabled people because the slightest thing can be misconstrued as discrimination, and if you are discriminating against someone because they are disabled you should have to be punished, which sounds like this person is being, I'm sure the Ohio conceled carry law must have some provisions which deal with disabled persons. Good luck getting back on your feet.

Denying right to selfdefense due to Pysical impairment. If they say that I'd get me a lawyer & challenge it all the way. thats B.S.

Good luck on rehab. I had to learn to walk again at age 41 and it was a *****. As a little kid learning to walk, if you fall you are already close to the floor so it is not so bad but when you are an adult and over 6' tall then the falls hurt much worse. I'm still no where near the same and will always handicap from now on but at least I'm alive.

I agree with the above, ADA suit if it is true, I bet it is just some bullshit about metal impairment that the cop in question miss understood or did not care to under stand and applied the statute incorrectly.

I am working on getting the whole story of what exactly went on right now.
I think the paper miss quoted the deputy, I have found out the man was arrested for concealed carry,even though he had a permit??

But no firm answers yet , but I am not going to let this one go .
This could be me?

I call shenanigans.... I would say that the Deputy was mis-quoted by the media. "Gasp... That just could not be!" :rolleyes:

There is nothing on the books which would exclude a physically impaired person from having a CCW. Mentally, maybe, but no way on the physical part. So rest easy. All the internet laywers can calm down about their "Sue them!!" rants. :D

I think someone misunderstood - either the cop misunderstood the law, or the reporter misunderstood what happened. In Arizona there is certainly no restriction against disabled people getting a CCW. There are people in wheelchairs who have them. As mentioned in other posts - they probably need them worse than the rest of us.

I'm sure you could get some quick answers if you call one of your representatives and ask if it's true that the state discriminates against Americans with disabilities in the issuing of CCW permits. Likewise, contact someone who represents ADA issues and ask them. But maybe your first call should be to the police to ask if they discriminate against Americans with disabilities, as indicated by the news story. You don't have to tell them you own guns -just that you are researching the issue so you can report on it accurately. (You will be reporting on it - in this forum - right?)

I'm waiting on the response from the reporter who wrote the article. I emailed him and waiting. I don't want a sh$t storm here ,I just didn't believe a handicapped person would be treated like that with having a permit. And since I was in the hospital for a few months maybe I missed something? I hope not! Thanks great response
